YICHosting, ("The Company") agrees to give services to clients providing clients have read and understood all policies. Further, clients must agree to all of them. Upon subscribing to any of The Company's services, the client agrees that they have read and understood all of our terms and agree to them. Responsibility for contentYou, as a YICHosting client, are held fully accountable for all content stored on your YICHosting account. SPAM and other unsolicited commercial usage YICHosting does not permit the sending of any unsolicited email or SPAM. Clients are not permitted to host any any sites, software or scripts that collect information such as email addresses, for the sending of SPAM or any other type of unsolicited email. Violation of this term will carry severe consequences. Upon notification of violation of this term, YICHosting will initiate an immediate investigation into the appropriate accounts to determine if this term or any other like it has been breached. During this investigation, YICHosting can, at our sole discretion suspend, restrict or disallow network access to carry out a successful investigation. YICHosting reserve the right to contact the relevant authorities if this term has been breached. All account data can and will be used as evidence against you if necessary and will passed over to a requesting authority. Breaches of this term will require that the client make an immediate payment of £250 to YICHosting as an administrative fee over your account. Failure to pay this fee in full will result in referral to an external agency and/or Her Majesty's Courts. SupportYICHosting will always attempt to provide the best support possible to clients and potential clients alike. Though, it is not always possible for YICHosting to assist with support requests where software that is not operated by YICHosting is installed, For example, scripts installed from Fantastico. In all circumstances we will work with clients to rectify any problems that may have arisen. Full assistance will be given over software that is preinstalled, such as DirectAdmin. DisclosureThe AUP, TOS and Privacy Policy specifically forbid the use of our network to commit or engage in illegal activities. As a result, the client or otherwise agrees that YICHosting may pass on relevant information to authorities such as the police or other law enforcement or security agencies. ResellingHosting accounts may only be used to host content belonging to the account owner, up to a maximum of 3 seperate domains or identities unless otherwise agreed with YICHosting. An appropriate reseller account must be purchased if any part of our service is rented, sold, given free, or otherwise used by any external Person, Company or Organisation. Domain namesDomain names registered by YICHosting will only be transferred away from YICHosting if a fee of £49 is paid in full. In addition, domains that were discounted, free or purchased under any offer are non transferrable under any circumstances, unless authorised by YICHosting. IP allocationIP addresses provided by YICHosting to a client are not to be considered owned by the client. The IP addresses are allocated on a lease, and may be changed or reassigned at the discretion of YICHosting. They remain the property of YICHosting. IP addresses can not be sold, rented or otherwise used improperly by the client. Service ratesThe client acknowledges that the nature of the service provided has been communicated to them. The client is also aware that YICHosting may make changes or modifications to the charges from time to time. We will always attempt to notify you of these changes, should they take place, however, the right to make changes without notice is reserved. PaymentPayments are due on the fifteenth day of each month, quarter, half-year or year, except where a cancellation has occurred or an alternative agreement has been made. The client is aware that YICHosting charge automatically on this basis again, except where a cancellation is under agreement. This payment cycle will be known as a 'billing period'. YICHosting reserve the right to charge clients 1 to 7 days before the actual payment date of the account, in order to ensure that the payment is cleared by the payment date and protect your account from suspension, termination or any other interruption. Payment and feesCredit cards that are declined will be subject to a declination fee of 15% of the transaction value, or £10, whichever is higher. Services, paid for or otherwise, can be suspended or terminated immediately, though YICHosting will often give a four day grace period allowing the client four days to pay the full cost of the account. If this grace period is granted and the amount remains unsettled, suspension or termination will occur on the grounds that payment has not been made to YICHosting for services provided. If a client refutes a charge, or initiates a reversal of any charge made by YICHosting, and after investigation, YICHosting feel that the charge was made within the provisions of our policies - an administrative fee of £49 will be charged to the client. You also note that all payments made to YICHosting are non refundable. This includes payments for services that have not yet been provided, unless a mistake is made by YICHosting. YICHosting may use fraud detection and/or prevention methods to assist us when processing your order. You agree that YICHosting, or any third party authorised by YICHosting may use any information you provide to further investigate any suspicion of fraud at any time. Failure to payYICHosting may take civil action against clients that have not paid for their services with YICHosting. YICHosting reserve the right to immediately, or later suspend or terminate any account without notification, under any circumstance. Any data that is on the account may only be collected once the client has paid the full cost of missed payments, plus interest of 15% per month, and a £25 administrative fee. Account cancellationAll requests to cancel services with YICHosting must be made via e-mail to This e-mail address is being protected from spambots. YICHosting reserve the right to deny cancellation of any account that can not successfully pass security checks, or where the account holder is bound by contract. LiabilityThe client is aware that the service is provided subject to interruption at any time. The company, YICHosting, informs the client so that they are aware upon signing up for any service that YICHosting is never liable for any loss or damage to the maximum extent of both the United Kingdom Legal System, and the United States Legal System. Suspension or service cancellationYICHosting reserve the right to suspend, restrict or terminate services at any time, for any reason, without prior notification to the client. If breaches of any of our terms have been detected, or for any legitimate reason as defined by YICHosting, any accounts managed by that client may be interrupted or terminated. It is the responsibility of this client, not YICHosting to provide an explanation regarding why there was/is a loss of service to any third party. ChangesChanges of our policies can occur at any time with or without notification, although we will always try to give reasonable notice. All users of our network in any way, visitors, account holders or otherwise must agree to all of our policies and fully abide by them. IndemnificationYICHosting wishes to emphasize that by making agreement to the YICHosting Acceptable Use Policy (AUP) and Terms of Service (TOS), customer indemnifies YICHosting for any violation of the Acceptable Use Policy (AUP) and Terms of Service (TOS) that result in loss to YICHosting or the bringing of any claim against YICHosting by any third-party. This means that legal action is taken against YICHosting as a result of a customer's or a customer of a customer's activity, the customer will pay any damages awarded against YICHosting, plus all costs and legal fees. Customer acknowledges that the service provided is of such a nature that service can be interrupted for many different reasons and interruptions can be prolonged due to external or internal events. Therefore, subscriber agrees that YICHosting shall not be liable for any damages arising from such loss of service for any reason. In no event shall the company be liable for any special or consequential damages, loss or injury. YICHosting accepts no responsibility for any actions that may arise due to clients not providing valid contact information. Including, but not limited to the suspension of an account set up until correct information has been provided.
